THE ROLE OF MEDIATION IN RESOLVING LEGAL DISPUTES: THEORETICAL AND COMPARATIVE LEGAL ANALYSIS

This paper explores the theoretical and legal foundations of mediation as an alternative method for resolving legal disputes. It focuses on the development of mediation in Uzbekistan following the adoption of the Law on Mediation (2018) and examines how this mechanism aligns with international standards and practices in other jurisdictions, including the European Union, the United States, Canada, Japan, and Germany. The study identifies key advantages and limitations of mediation, analyzes its impact on judicial efficiency, and discusses the prospects for its further development in Uzbekistan’s legal system. The results emphasize the growing importance of mediation as a tool for promoting access to justice, reducing court congestion, and fostering a culture of peaceful conflict resolution.
